Seoul Semiconductor Co., Ltd. filed a patent invalidation trial with the Korean Patent Court of the NICHIA Chemical Industry Co., Ltd. (hereinafter referred to as NICHIA), and a trial of the scope of the powers. On July 25, it stated that the new regulations were insufficient. The reasons for the judgment were all invalid and non-infringing, and the judgment of Seoul Semiconductor was won.
Seoul Semiconductor's technology is different from the patents that are now ineffective. In May 2008, NICHIA filed a lawsuit against the UK court for patent infringement. A related person from Seoul Semiconductor said that the decision will positively affect the corporate activities of Seoul Semiconductor and Seoul Semiconductor's dealer Avnet EMG.
In addition, Seoul Semiconductor has requested the US Trade Commission to ban the import of laser diode products from NICHIA. This request was received in mid-January and is now under investigation. It will be decided in early 2009. In addition, the core technology of all LED, UV, LD and other products used in NICHIA is infringing on the patented technology of Seoul Semiconductor, and is now appealing to the US and other courts for patent litigation.
