Hisense and Sharp have entered a new phase in their ongoing patent dispute. It has been reported that Hisense has filed a lawsuit against Sharp for alleged patent infringement, and the case has been officially accepted by the courts in Beijing and Qingdao. The company is demanding that Sharp immediately cease the sale of infringing products and take corrective actions.
On November 29th, Hisense Electric, a subsidiary of Hisense Group, officially launched legal proceedings in both Beijing and Qingdao, accusing Sharp of infringing on its invention patents through more than a dozen TV models sold in China. These products are available in over 30 provinces and cities across the country. A relevant image shows Hisense's counterattack against Sharp’s alleged patent violations, with demands for Sharp to stop manufacturing, selling, and offering infringing products for sale.
The patents at the center of the dispute include "a backlight control method, device, and LED TV" and "backlight drive circuit and TV," both of which are still within their valid periods. In its complaint, Hisense is seeking a court order to compel Sharp to stop all infringing activities, including production, sales, and future offers to sell, as well as the destruction of any infringing goods. Both the Beijing and Qingdao courts have officially accepted the case.
This conflict dates back to 2015 when Sharp handed over its Mexican factory to Hisense amid operational challenges. At the same time, Sharp granted Hisense the five-year right to use the Sharp brand in the U.S. market, excluding Brazil. After taking over, Sharp’s operations in North America improved significantly. However, after Foxconn acquired Sharp in 2016, it violated the contract by terminating the brand rights. Hisense refused to comply with this unreasonable request, leading Sharp to publicly threaten “destructive actions†to reclaim the brand.
Since the beginning of this year, the dispute over the Sharp brand in North America has escalated. Behind the scenes, Foxconn, which had a contract with Hisense, sought to regain the Sharp brand but failed. Faced with this situation, Foxconn turned to litigation and even initiated Section 337 investigations with the U.S. government. This has been likened to a modern-day tale of "the farmer and the snake." However, it was reported that Sharp’s lawsuits against Hisense in the U.S. have repeatedly failed. On November 13, the U.S. District Court for the District of Columbia dismissed Sharp’s case, rejecting its motion to impose a ban on Hisense.
This time, Hisense is no longer staying silent in response to Sharp’s actions. The company’s decision to pursue legal action reflects the growing confidence and assertiveness of Chinese enterprises when facing foreign patent barriers. As the two companies engage in legal battles on both sides of the Pacific, and as tensions escalate into broader trade disputes, the legal community is closely watching the developments.
Moreover, Sharp’s situation in China goes beyond a simple corporate dispute. Its low-price strategy has drawn criticism, and there have been multiple consumer complaints about product quality. According to public reports, over a dozen lawsuits have been filed by consumers this year against Sharp for quality-related issues.
